In these Terms and Conditions “we” and “us” mean Oak Bazaar ABN 53 354 427 141 and “you” means you the customer.

The Oak Bazaar online email address is info@oakbazaar.com.

These Terms and Conditions together with your Order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply.

The Contract cannot be varied unless we agree to vary it in writing or by email once you have placed your order.

1.1 Age Capacity to Transact

If you are under the age eighteen (18) years you can’t place orders with Oak Bazaar. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. 
Should Oak Bazaar suffer any damage or other losses as a result of a transaction entered into by a minor, Oak Bazaar reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Oak Bazaar.

1.2 Our Guarantee

Oak Bazaar is committed to our customer’s satisfaction, ensuring you are happy and satisfied with your order. Please notify immediately by email at info@oakbazaar.com if you have any problems with your order once you have received it.

Many of the Oak Bazaar products are handmade using natural and recycled materials. The same product may not always be identical with slight variations that enhance the character and charm of our products.

1.3 Product Prices

All prices, charges and transactions are in Australian Dollars (AUD) and are NOT subject to GST.

Oak Bazaar reserves the right to change prices without notification for products displayed on our online site (www.oakbazaar.com) at any time. The price payable for the goods shall be the price applicable on the date the goods are ordered. We will endeavour to display the most current prices but errors may occur.

1.4 Payment Methods and Processing

The Oak Bazaar website (www.oakbazaar.com) currently accepts PayPal, Visa and MasterCard. Oak Bazaar uses a secure third-party payment processor to keep your credit card details safe.

Oak Bazaar also provides customers with an offline ordering and direct deposit option for customers that do not want to provide credit card details online. Email us at info@oakbazaar for additional details about the offline process.

1.5 Offline Ordering and Payment

If you are still not comfortable purchasing online you may browse the Oak Bazaar online shop, make an off line wish list and email us at info@oakbazaar.com with your final order. Once confirmed by Oak Bazaar that we have the items in stock, Oak Bazaar will email you a confirmation email, which includes total cost, and direct deposit banking details you can transfer funds to. Once you have made the payment please notify us via email and once the payment has been received we will arrange for dispatch of your order. Please allow approximately 5 days for delivery. We shall not be liable for any losses incurred by you transmitting information to us by email or post. Any such losses will be entirely your responsibility and shall not be the fault of Oak Bazaar.

1.6 Product Availability & Status

Each item listed at www.oakbazaar.com will have listed availability in the product detail section. For example it will state if the product is in stock, out of stock and expected date of delivery or limited stock available.

1.7 Deliveries

We’ve done our best to make delivery as easy and cost effective for you as possible. Oak Bazaar uses the services of Australia Post to deliver orders, but there may be times when, despite their best efforts, parcels are delayed in the delivery process. Included in the delivery cost is packaging your order so it arrives to you undamaged. Although there is a delivery charge involved in shopping with www.oakbazaar.com, we believe that you will in fact save money – not to mention your time and energy – by shopping via the Internet. 

We often do not acknowledge the costs in transport or petrol and parking to go shopping or time for that matter. We also believe the products we sell at Oak Bazaar are unique and something you rarely find at shops. We believe that our product pricing is competitive particularly with the high quality.

Orders placed on a weekend or a public holiday will not be processed until the next business day. Business days are Monday through Friday, excluding NSW Public holidays. If you still have questions after reading the following, please contact us at info@oakbazaar.com

1.8 Shipping and Handling Prices

Oak Bazaar charges a flat shipping and handling rates (There are delivery options you can select from). Prices are outlined below and are in Australian Dollars. Australia Standard: AUD $4.95 (Allow up to 4 to 75working days) Unless otherwise requested at the time of ordering, wrapping paper ordered with other products is delivered folded. If you would like your wrapping paper rolled it will cost you an additional $7.95 and will be delivered as a separate additional package (Cylinder) to the other items you have purchased. Australia Express: AUD $14.95 (Express delivery takes up to 4 working days) Please note: All orders are sent from Bowral. If you live in WA, NT, Far North Queensland or remote rural areas you may need to allow a few extra days for postage. Outside Australia International orders are sent via Air Mail Express (Via Australia Post), which means to most locations your order should be delivered within 7-14 days (Approx). Delivery times for international orders do vary and depend on destination. International customer should browse the website and email your order to info@oakbazaar.com and we can give you a shipping quote for International shipping.

Processing will occur offline for international orders. Please note: It is the customer’s responsibility to pay any overseas customs duties, foreign taxes or other fees that may be imposed. Check with your local customs office for more information.

1.9 Delivery Estimates

Oak Bazaar makes every practical effort to ensure that delivery timeframes given are accurate (currently 4 – 5 working days). However the delivery times stated for products on this site assume that the stock and that delivery times are not adversely affected by unforeseen events.

By placing an order, you agree not to hold Oak Bazaar liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

2.0 Colour Variations

We have endeavoured to ensure that product images are an accurate colour representation of the actual product, however onscreen colours may appear slightly different depending on how your particular monitor screen is calibrated. The colour combinations in card and envelope packs may also vary from those displayed online, this may also be due to lighting in photography. In addition, whites, creams and gold are especially difficult to represent accurately. If you are unsure please email i nfo@oakbazaar.com.

It is important to note that most of our paper products are handmade using recycled material so colour and textures may vary slightly across the packs.

2.1 Errors & Discrepancies

Any errors and discrepancies must be brought to our attention within seven days of receipt of goods. This needs to be done via email info@oakbazaar.com

2.2 Return Policy

All products will be quality checked before dispatching and will be carefully packaged before dispatch. However, should an item arrive faulty or damaged, we will happily arrange replacement, exchange or a refund.

(A) Process for returning damaged goods: Please notify us by email first at info@oakbazaar.com explaining the reason as to why you are returning the goods and provide a digital photograph of the damaged item. We reserve the right to refuse a return on any product that does not deem itself faulty or damaged. Once approved by Oak Bazaar, a replacement item will be dispatched or a refund made by direct deposit into your account.

(B) Process for returning goods for other reasons: If you choose to exchange a product for any other reason then the delivery costs are non-refundable unless we have made an error in your order. The goods must be returned in original condition, unopened and unused and must be received within 7 days of purchase accompanied with proof of purchase, your name, contact details and reason for return. Items may be exchanged for items of the same value or a refund can be made via direct deposit into your account (excluding postage costs).

Returns policy does not apply to items purchased at sale prices. All sale items are final sales and no exchanges or refunds will be given unless the product is deemed faulty. Unfortunately we cannot refund any postage, freight or courier costs incurred. When returning items you will need to cover postage costs.

(C) All returns must be pre-arranged with Oak Bazaar within 7 days of delivery and returned to Oak Bazaar within 14 days of purchase. It is advisable to return products via registered post, as Oak Bazaar will not be held responsible for any product lost or damaged in delivery.

You will be responsible for shipping and handling charges associated with returns. A return address will be emailed to you at the time you contact Oak Bazaar.

2.3 Our liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind arising and whether caused by tort (including negligence), breach of contract or otherwise.

Our maximum collective liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

2.4 Credit Card Fraud

Oak Bazaar will not be responsible for any damages, significant losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

2.5 Force Majeure

Oak Bazaar shall not be liable for any delay in performing any of its obligations under these Terms and Conditions, if such delay is caused by situations beyond the reasonable control of Oak Bazaar, and Oak Bazaar shall be permitted to a reasonable extension of time for the performance of such obligations.

2.6 Governing law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of New South Wales Australia and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales Australia.

2.7 Other terms

We do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.

2.8 Disclaimer

The information contained on the website is provided by Oak Bazaar in good faith. To the best of Oak Bazaar’s knowledge, the information is accurate and current. However, Oak Bazaar do not make any representation or warranty as to the accuracy or completeness of the information. To the fullest extent permitted by applicable law, Oak Bazaar disclaims all representations and warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Oak Bazaar makes no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements.

You further acknowledge and agree that, subject to the section dealing with ” Our Liability”, Oak Bazaar will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from use of goods supplied to you, or on behalf of you, through the website.
